Elisha M. Lowrey's Application to

the Dawes Commission

In 1896, Elisha Middleton Lowrey filed an application with the Dawes Commission to establish his Cherokee descent, thus entitling him to certain benefits, including land. Swearing on his behalf were his uncle Elisha, his brother Philip, and a friend, N. W. Blalock of DeKalb Co, AL..

Application for Enrollment:

To the Honorable Henry L. Dawes, Frank C. Armstrong, Archibald S. McKennon, Thos. B. Cabaniss and Alexander C. Montgomery, United States Commissioners authorized by an Act of Congress of June 4, 1896, to hear and determine Claims for Citizenship in the Cherokee Nation.

Gentlemen: The undersigned, your petitioner, Elisha M. Lowrey for and on behalf of himself and heirs, this day makes this their application to you for the purpose of being placed on the revised roll of Cherokee Indians and of those entitled to share in the distribution of funds and allotments of land in the Cherokee Nation, by virtue of their Cherokee blood and I herewith submit the evidence in support of said claim and respectfully await the time when the application shall be heard and tried.

To the Honorable Henry L. Dawes and others Composing the Commission to the Five Civilized Tribes;

Your Petitioner, Elisha M. Lowrey would state and show from the proof submitted to the Commission that he is a Cherokee by decent and by blood having been born in Franklin County, State of Georgia on 30th day of July 1828. My father's name was Amos Lowrey. My mother's name was Eliza A. Lowrey. That I now reside in Wagoner, Indian Territory and have resided there for three years. And he avers these facts can be established by proof to the satisfaction of the Commission under such rules and regulations as it may prescribe. And he further avers that these facts being proved he is entitled to be adjudged under the laws of such Nation and the laws of the Congress of the United States and the treaties of such Nation with the

United States, a citizen of such Nation, with all its rights, privileges and protection of Citizenship in such Nation. Wherefore he herewith respectfully submit to the consideration of the Honorable Commission such proof and on the hearing he be adjudged entitled to such citizenship and his name be placed upon the proper toll as a citizen of such nation.

Affidavit #1:

The State of Georgia Whitfield County

Be it remembered that on this the 4th day of May, 1892 personally appeared before me an acting notary public and exofficia justice of the peace, in and foresaid County and State, Elisha Lowrey who is a reliable and creditable citizen of the afforesaid state and county and after being by me duly sworn according to law, deposeth and sayeth he is a resident of Whitfield County and State of Georgia, this his age is 75 years and his occupation is that of a farmer and post master and that his adress is Effie Post Office, Georgia. That he is well and personally acquainted with Elisha M. Lowrey who now lives in Crawford County, Arkansas, near Belmont Post Office, and knows that the said Elisha M. Lowrey is the identical person that he represents himself to be. The he is a son of Amos and Eliza Ann Lowrey, maiden name Eliza Ann Albbritton, both dead and grandson of Elisha Lowrey and Mary Lowrey, maiden name Mary Brawner, both dead, and great grandson of John Lowry and Sally Lowrey of North Carolina and great nephew of Tomey Lowrey, William, James, and Edmond and Meshack, all dead. All of most of them of North Carolina and

Georgia near the state line. Affiant makes this sworn statement from his own personal knowledge and acquaintance with the Lowrey family.

Be it remembered, that on this 26th day of June, 1896 Personally appeared before me, P. L. C. Lowry who is a reliable and creditable citizen of the county of Heard, State of Georgia and after being duly sworn according to law, deposeth and says: The he is a resident of the County of Heard, State of Georgia, this his age is 72 years; occupation that of farmer that Postoffice is ?; that he is personally well acquainted with Elisha Lowrey who is a son of Amos and Eliza Lowrey of Georgia and grandson of Elisha Lowrey of Georgia and great grandson of John and Sallie Lowrey of North Carolina and Georgia at or near Blairsville. Affiant makes this his sworn statement from his own personal knowledge and acquaintance with the family.

The State of Alabama DeKalb County

Be is remembered that on this the 5th Day of February 1892 personally appeared before me Lake Moore, and acting Notary Public and exofficio Justice of the Peace in and for said county and state, N. W. Blalock, who is a reliable and creditable citizen of the aforesaid state and county and after being by me duly sworn according to law deposeth and saith he is a resident of DeKalb County, State of Alabama, that his age is 78 years and his occupation is that of a physician and Minister of the Gospel and that his address is Fort Payne, Ala. That he is well and personally acquainted with Elisha M. Lowrey, who now lives in Crawford County, Arkansas, near Belmont Post Office and swears that said Elisha M. Lowrey is the identical person that he represents himself to be, that he is a son of Amos and Eliza Ann Lowrey and grandson of Elisha Lowrey and great grandson of John and Sallie Lowrey of North Carolina and Georgia near Blairsville town, and that the said Elisha M. Lowrey who now resides in Crawford County, Ark near Belmont Post Office, also had a great uncle John Lowrey and a great aunt, Sallie Lowrey who use to live in North Carolina and then in Georgia near the line of those two states. Afficant makes this sworn statement from his own personal knowledge and acquaintance with the Lowrey Family.
