WILL OF JOHN LOWREY

 

John Lowery wrote his will on Sept 13, 1807. The following  transcription of that will was contributed by Peggy Heard.


In the name of God, Amen, I John Lowrey of the state of GA & County of Franklin being infirm in body but in perfect mind & memory do make & ordain this my last will & testament in the form following:  that is to say, I give & recommend by soul into the hand almighty God that gave it & my body I recommend to the earth to be decently entered at the discretion of my executors & touching such worldly estate which it hath pleased God to bless me with. I will & bequeath in the following manner & form that is to say:  I will & bequeath to Ellender Lowrey my dearly beloved wife, the land I now own on Hudson River & likewise all my moveable property & every thing that I posses whatsoever it may be to be  possessed by her during her widowhood & if she should marry then all to be sold & equally divided among her & the children & at her death all to be & equally divided among the children.  Likewise I constitute make & ordain Ellender Lowrey my dearly beloved wife & James Lowrey my dearly beloved son executors of this my last will & testament.  Likewise I will that my executors sell or buy with consent of each other anything for the use of the family on the plantation.  In witness whereof I have hereunto set my hand & seal this 13th day of Sept 1807.

In the January term of 1808 personally came William Lowrey & John Parks in open court & being duly sworn do say that they were subscribing witnesses to the makers will & that they saw David Lowrey subscribe his name as witness.

Lowreys that bought at the estate sell on 7 Jan 1813 were:  Nathan, Charles, James, Shadrack, John, Elizabeth & Benjamin.  Also James C Cook, Charles Toney.

Legatees named:   Middleton Lowrey, John B Lowrey, Allen Cook, Nathan Lowrey, Charles Lowrey, Elizabeth Lowrey, Shadrack Lowrey, James Lowrey Jr., Burrell Cook & Polly Lowrey.
